This is a legal and binding agreement between Half Moon International Inc.. 16103-98 Street, Edmonton, Alberta, T5X 4Y6, Canada and you, the Artist/Crafter for Half Moon International Inc. to sell Art/Craft(s) where Half Moon International Inc. manages all or part of the Showcase space for the term of the Showcase Agreement.
For this agreement to become effective the Artist/Crafter submission of payment must be:
Half Moon International Inc. - makes no warranties, expressed or implied, other than those presented in this agreement.
It is the responsibility of the Artist/Crafter to set the price for Art/Craft(s) posted to the website.
It is the responsibility of the Artist/Crafter to advise Half Moon International Inc. if the Art/Craft(s) posted on the website have been sold or are no longer available for sale so they may be removed from the Showcase.
It is the responsibility of the Artist/Crafter to supply accurate weight and dimensions to Half Moon International Inc. for the purpose of determining shipping costs.
It is the responsibilty of the Artist/Crafter to ship their Art/Craft(s) per agreed upon shipping preference indicated by Half Moon International Inc. to the buyer once they have been paid for the Art/Craft(s) and shipping by Half Moon International Inc.
It is the responsibility of Half Moon International Inc. to notify the Artist/Crafter how the Art/Craft(s) are to be shipped.
It is the responsibility of Half Moon International Inc. to collect all monies for Art/Craft(s) and shipping and to forward collected monies to the Artist/Crafter for their Art/Craft(s) sold on Half Moon International Inc.
It is the responsibility of Half Moon International Inc. to determine the options and costs for shipping and to notify the customer of the shipping options. Once it is determined how the customer would like the Art/Craft(s) shipped the customer will be billed for the shipping.
Half Moon International Inc. will be responsible for adding the Art/Craft(s) to the database in a timely fashion once a Showcase Agreement has been received, approved and images provided.
The Artist/Crafter warrants that the use, reproduction, distribution, or transmission of the Art/Craft for the purpose of this Agreement will not violate any criminal laws or any rights of any third parties, including, but not limited to, such violations as infringement or misappropriation of any copyright, patent, trademark, trade secret, music, image, or other proprietary or property right, false advertising, unfair competition, defamation, invasion of privacy or rights of celebrity, violation of any antidiscrimination law or regulation, or any other right of any person or entity. Artist/Crafter(s) agree to indemnify Half Moon International Inc. and to hold the company harmless from any and all liability, loss, damages, claims, or causes of action, including reasonable legal fees and expenses that may be incurred arising out of or related to a breach of any of the foregoing representations and warranties or any other dispute or claim which may arise in relation to Art/Craft(s) or promotional efforts on Half Moon International Inc.'s behalf, irregradless of whether such dispute may be due to the success or the lack of such in any promotional effort. The Artist/Crafter agrees to request that Half Moon International Inc. be listed as an additional insured on any policy issued to the Artist/Crafter pursuant to which there could be coverage for any of the forms of legal liability described in this paragraph.
By SUBMITTING payment the Artist/Crafter(s) or person(s) ordering and /or reserving Showcase Space agree to abide by the above terms and conditions.
